(i) it has recorded pre-tax losses for the three (3) most recently completed consecutive financial years (based on audited full year consolidated accounts); and
(ii) its latest 6-month average daily market capitalisation as at 08/04/2019 is S$117.97 Million

the Company wishes to update that pursuant to the Settlement Deed dated 24 November 2020 entered into with the Rubicon Parties, Rubicon has withdrawn its winding up petition in the Cayman Islands against KEGOT and this has been confirmed by an order of the Grand Court of the Cayman Islands.
